PLANNING COMMISSION MEETING

JUNE 26, 2024

 

John Hutchison (Chair) called the meeting to order at 6:30 p.m.  In attendance were Commission members Owen Bailey, Jim Gatto, Cinda Pitcock, Jay Silcox, Heidi Usilton, and Elizabeth Watson. Also in attendance was Lynda Thomas (Town Clerk).   

MINUTES

Mr. Hutchison asked if there were any corrections or revisions to the minutes of the meeting of May 15, 2024. Commissioner Silcox moved to approve the minutes of May 15, 2024, as amended. The motion was seconded by Commission Watson and passed unanimously.

LOT LINE ADJUSTMENT – BP240092 – 202 CALVERT STREET

Mr. Bruce Walther presented a lot line adjustment for 202 Calvert Street.  It was proposed to subdivide half of parcel 841, lot 2, and join to the half to the 202 Calvert Street property. It was noted that the road access easement would not be affected by this lot line adjustment.

Commissioner Silcox made a motion to approve the line indicated on the plan, south of the property, to be removed. The motion was seconded by Commissioner Bailey and passed unanimously.

VARIANCE REVIEW – BP240067 – TOWER PLACEMENT

Representatives from Talkie presented a 100-foot tower placement on the Talkie property at 99 Talbot Boulevard on the back side of the property at the tree line or in the trees. A variance is required for this RB – Professional Office zoned property which only allows for dwellings units to be a maximum height of 40 feet. The tower would allow for the of access local channel for their IPTV programming. The current 10-foot antenna does not provide a clear picture.

It was noted that there would not be anything visible permanently installed on the tower.

The representative reported that a short test will be performed by installing a 6 GHz point to multi point unit to the tower and aiming it at High street. If this technology works, it would allow Talkie to be able to provide wireless internet in areas where fiberoptic cannot reach. It was noted that if this unit works, Talkie may return to get approved to use this technology to provide High Street wireless internet if fiberoptic proves too challenging for the area.

Commissioner Silcox made a motion to recommend to the Zoning Board of Appeals two (2) variances for a 45-foot height restriction and conditional use of a town. Both variances are recommended and approved to be limited only to tv service and a six (6) month 6GHz point to multi point test run.  The motion was seconded by Commissioner Watson and passed unanimously.

PRELIMINARY/FINAL SITE PLAN REVIEW – RADCLIFFE MEADOWS SUBDIVISION

Fred Sheckells and Kristen Blood presented the Preliminary/Final Site Plan Review of the villa design for Radcliffe Meadows Subdivision.

Ms. Blood presented the street view of the residential homes, street trees, trim options and rear porches.

There was a discussion regarding the traffic on Talbot Boulevard and the safety of the students at Radcliffe School. 

Mr. Bailey stated he would perform a traffic study in front of Radcliffe, over the summer, to test some ideas to see what works best and would bring the results back to the Planning Commission. He noted that he would be volunteering his time for this demonstration project for the town and Radcliffe Creek School.

Commissioner Watson made a motion to approve the preliminary site plan. The motion was seconded by Commissioner Silcox and passed. Commissioner Gatto abstained from the vote.

At this point in the meeting, Mr. Hutchison stepped down as chair to present the following two (2) agenda items.  Mr. Bailey stepped in as chair.  

VARIANCE REVIEW – BP240085 – 216 CALVERT STREET

Mr. Hutchison reviewed BP240085 – 216 Calvert Street for a recommendation to the Zoning Board of Appeals.

Mr. Hutchison reviewed a front variance requesting a 7′ relief of the required 20′ front yard setback. He noted that an existing masonry stoop, measuring 14.3′ off the front property line, is proposed to be demolished and a new covered porch with the front of the porch being 14.8′ off the front property line with two steps measuring 13′ off the front property line is proposed to be constructed. He noted that the required front setback for R-3 Zoning is 20′, which is an unusual condition, considering the majority of the nearby homes on this street have porches very close to the front property line.

Mr. Hutchison also reviewed a rear variance request with a 5.7′ relief of the 25′ rear yard setback, which would be the 25′ rear yard setback line if the lot was 100′ in depth. He noted this request would be for a new 4-season room addition at the rear, measuring 19.3′ off the rear property line. The existing lot is a non-conforming lot, because the zoning requires a 100′ depth, yet this portion of the lot is only 94.27′.

Mr. Hutchison indicated that due to the nonconformity of the existing lot and the unusual condition created by having the adjacent structure so close to the front property line while this building sits 20′ back. He also noted that a front porch would benefit the streetscape of the entire block.

Commissioner Gatto made a motion to recommend the variance, BP240085 – 216 Calvert Street, to the Zoning Board of Appeals for both the front and rear projects, as presented. The motion was seconded by Commissioner Silcox and passed unanimously.

VARIANCE REVIEW – BP240046 – 118 N QUEEN STREET

Mr. Hutchison reviewed BP240046 – 118 N Queen Street for a recommendation to the Zoning Board of Appeals. He noted that this project had already been reviewed by the Historic District Commission.

Mr. Hutchison reviewed a front variance requesting a front yard variance relief of 19.6’ (0.4’ from the property line).  The existing front stoop, measuring 1.6’ off the front property line, is proposed to be demolished. A new covered porch with the front of the porch and step measuring 0.4’ off the property line is proposed to be constructed. The required front setback for R-3 Zoning is 20’, which is an unusual condition, considering the majority of the homes on this street are historic and have porches very close to the property line. 

Mr. Hutchison indicated that a majority of the houses on this block have front porches and would benefit the streetscape by adding a front porch to this structure.

Commissioner Gatto made a motion to recommend the variance, BP240046 – 118 N Queen Street, to the Zoning Board of Appeals, as presented. The motion was seconded by Commissioner Pitcock and passed unanimously.

There being no further business or questions from the audience, Mr. Silcox moved to adjourn the meeting at 9:25 pm. The motion was seconded by Mr. Gatto and carried unanimously.
